Legal Question in DUI Law in California

Sue the DMV

Can i sue the DMV. I got a dui when i was 19, they found me not guilty in court but the dmv found me guilty. at the dmv hearing the officer who gave me the dui was not there, and the cop who was i had never seen him. i asked if i could appeal it and they said no because i was under 21. i am having the worst time looking for ajob because many ask if you have a dui. i dont think its fair and have suffered much emotional stress over this. i was found nto guilty by the evidence that was presented and the dmv wouldnt even let me have the right to appeal because of my age.

Re: Sue the DMV

When a potential employer asks whether you have been convicted of a crime they mean criminally. The DMV hearing is an administrative hearing and has nothing to do with the criminal process. So you can state that you have never been convicted of a DUI because you haven't.

Best of luck.
