Legal Question in DUI Law in California

I'm twenty years old. Last night me and my buddies got a citation for drinking in public (in a car ofclub parking lot). I got a misdemeanor.

This will really ruin my chances of being a sheriff dispatcher for my city, I already have passed my most of my tests and the next one is extensive back ground check.

Will this misdemeanor be cleared off my record? How long does it stay on there? Do you think I can get the judge to sympathize with me seeing that I'm really good people who wants to work for the law?

I don't know why you are even thinking about this being on your record if you just got the ticket last night.

If convicted of a misdemeanor, it will always be on your record, even if you expunge it because 1203.4 does not seal records it only dismisses charges.

You have a lot of options and I would be glad to go over them with you if you like. Feel free to contact my office with any questions you may have.

In the computer age, everything is ALWAYS on the record. But you may be able to get the charge NOT FILED of , if filed, either REDUCED to an infraction, or possibly DISMISSED, after the filing. Our office has handled 100's of these types of cases, and as a Former Deputy District Attorney, and a Certified Criminal Law Specialist, my advice to you is ....speak to a qualified criminal defense attorney in or near your area. If you desire , I would be more than happy to hear all the facts and tell you what I think about your case. Call me at 661-267-1313 if you want to hear my views on the matter. David Wallin

Once convicted, that record is forever.

Of course you can fight the charges. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney that does, who will try to get a dismissal, diversion program, reduction or other decent outcome through plea bargain, or take it to trial if appropriate. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
