Legal Question in Education Law in California

My brother is suppose to graduate nursing this December in one of the community college here in LA county. He did not disclose to the school and the nursing dept that he previously attended another community college. He wanted a fresh start. Now they are threatening to expel him because of 1. Falsifying documents 2. He failed physiology in the first school, failed once on his current school and got an "A" on his second try. Can they expell him?

Your brother needs to look at the wording of his application documents. There needs to be some express statement requiring that everything be disclosed. Failure to report attendance at another college is not necessarily "falsifying" documents. Also, I don't believe failing at a course would bear on the number of chances to retake a course at the new college. Generall, there isn't a requirement that you report attendance at other schools. Usually, schools are reluctant to grant credit for courses attended elsewhere, so it is irrelevant from their perspective that you took courses elsewhere, unless you are enrolling in a graduate program where their are prerequisite undergrad courses. I think this community college is out of line.
