Legal Question in Elder Law in California

Elder abuse

We have found out the conservator has been misusing the conservatees money by buying a brand new Mercedes. Can we still report abuse even if the car is not in the conservator's name? Can I get a lawyer order a freeze on her accounts to track her spending abuse?

If you have reason to believe mis-use of the conservatee's estate, then you may request an accounting and move to remove them as conservator. Contact me directly.

If you have evidence to back up your allegations, you can file a motion/petition in the probate proceeding that requests the court remove the Conservator and get back the misspent money. The court would require an accounting of all money to determine the truth. If serious about doing so, feel free to contact me.
