Legal Question in Elder Law in California

Referral agent moved Dad to get $

The referral agent who found a board and care for Dad (90 years old) lied to get me to agree to move him just as the month was over to another B&C. She advised it was due to licensing problems and that the current B&C was closing. My Dad has Alzheimers and is very confused. Moving him around alot confuses him even more. It's cruel. It's also very hard on the caregivers and myself. I agreed to move him under the circumstances but, hated the new place. I was also told one rental rate while the owner was told a higher rate. Upon discussing this with the owner, upon admission of my Father to their facility, I found that the way the referral agent makes her cut is by receiving the 1st months rent each time she places a patient. She was now placing my Father for the 3rd time in a row. He never stayed a full month. She got to keep all the money. The caregivers got zero. I called the previous facility and found out the licensing issue was untrue. Oh, she also had told the previous facility that I was the one requesting the move because I believed my Father was being hit by them. This was a lie. Anyway, I want to find out what recourse I have against this woman and her unethical behavior.

Re: Referral agent moved Dad to get $

For starters, lodge a written complaint with demand for recovery of your money with any company she is associated with, and with each of the places she has sent you through, and with any licensing agencies she claims to be working through. Then, consider filing a lawsuit for fraud and emotional distress. Your goal should be to recover the money you spent, and get her stopped. Contact me if interested in pursuing legal action.
