Legal Question in Elder Law in California

Sir, I have had a niece of my wife living with us for 3 yrs, 8 months, in sept, it'll be four yrs!! She does not pay rent ,does not help around the house, she comes and goes as she pleases, we've told her to be out by this Sept 30th 2016 , Question: If she doesn't move can we evict her ??

My wife and I are 81 years young, but she has just been taking advantage of us, for all these years, She works for "Trader Joe's' ,in Lafayette, Ca !!

Please advise us !!

If she has not been paying anything for the privilege of staying in your home, she is nothing but an at-will guest. You can have her removed as a trespasser, or you can do it a bit more orderly and go through a formal eviction, or you can just box up her things, put them outside and change the locks. She has no rights.
