Client Dumping

Under what circumstances, if you have a case

about to go to trial and an unsuccessful

settlement, can your attorney bail out on the case?

We have been in litigation for three years, about to

go before a judge expecting a settlement (which

isn't happening) and he will either dismiss the

case or set a trial date. Our attorney says he can

drop us if we have to go to trial. I hear that's not

legal. What's the deal?

Your attorney can drop you if he wants to. He is not supposed to if it will prejudice the case though.

There are not laws that say he cannot, so as a result it is not "illegal." However, there are ethical guidelines as well as malpractice guidelines that he should consult.

I am a trial attorney hired by other attorneys to try their cases for them, and usually I get the call just prior to trial.
