Should we keep our current band name?

A member of our band is passionately attached to our current band name. The problem is that we broke up for four years and recently reformed. In the meantime another band in Sweden has since been using the name. To make matters worse, our recordings are added to theirs on hundreds of websites, so if you do an internet search for our name you'll find four albums available for sale: 1 from us, 3 from them.

Since we have only recently reformed the band but established the name prior to the other band, do we have legal rights to the name? Really the main questions is this: Is it worth it to fight to keep the name, or is it better to change it early on.
