Non Refundable Money

My daughter made the Varsity cheer squad, and we started to pay money for it (non refundable). We have paid $800, and had to before the grades came out, and she is ineligible. I asked for a portion of the money back, because she will recieve no benefit from it. Can they just say it is ''non refundable'' and we have to let our money go just like that? She will not go to the $400 camp, or get the $180 spirit pack, or the $150 jacket, but I cannot have it back? Is this lawful?

Lawful or not, it's tremendously bad Public- and Community- Relations for the squad and school. I'd first raise the issue with the Squad instructors, then the Athletic Dept. Chair, then the Principal, then on to the School Board and the Press.

Also, look into whether there was any paperwork signed (by an adult) that acknowledged and accepted the "non-refundable" policy. If not, I think you'd succeed in Small Claims court.

Of course if your daughter will be eligible for the squad again in the future, you may not want to burn your/her bridges. You might ask that the money be applied again next year, etc...
