Legal Question in Entertainment Law in California

Privacy on the internet

I have an ex boyfriend who took it upon himself to display both my name and personal information which can only be identified and linked to me on his personal website. Though this information is not harmful or degrading, I am uncomfortable having it posted there for security and privacy reasons on the internet. I did not give him permission to do this. Does he legally have the right to post such information about me? And if not do I have any rights legally which could force him to remove such personal content from his site?

Thank you for your time and assistance.

Re: Privacy on the internet

No, he does not have the right to invade your privacy in this way. Privacy rights are separate from defamation and you do not have to show damages to protect your privacy.

I suggest you send him a written demand that he remove the items immediately (give him a deadline, say 24 hours), and leave you and your name off of his web site. If he does not do so by your deadline, send a copy of your demand to the website host (you can find out who this is by going to the Network Solutions website and using their "whois" feature), along with a note asking that they shut him down. Most hosts have regulations about such behavior and will want to avoid trouble.

If that doesn't work, consult with an attorney about enforcing your rights in court.
