Legal Question in Family Law in California

adultery

My husband and I are separeted but he doesn't want to file for divorce (since I am out of state since Sept.2005 I cann't file for divorce in CA and Puerto Rico I need to wait 2 years) and I have evicence that he has another partner. Can I suit him for adultery? We still very much married but separeted. Please advice. Thanks

In a general sense, you can file for divorce in California if your spouse meets the residency requirement in California (even though you do not). There is no cause of action for adultry in California.
