Legal Question in Family Law in California

Alimony Delivery Problem

I am having a problem with the Alimony checks I am sending for the last three checks that I have sent they have been return. Refused. I have been paying alimony for 2years I have till 5/2004 until it is complete. How am I to deal with this problem? My ex will not speak to me or give me any new instructions on delivery. Please advise. I do not want my wages garnished over this. What else can I do to get this done.

Thank you

Re: Alimony Delivery Problem

Perhaps she is remarried and not telling you?

Assuming you still have a support obligation, I would suggest you send her a letter by certified mail telling her what you said in your query here and informing her that you are depositing the funds into a separate account in your name which she can have whenever she wishes.

She'll probably refuse to take the certified mail, but it will give you evidence should she try to cite you for contempt of court.

I don't know why you consider a wage assignment such a big deal; it is automatic and does not indicate anything negative nowadays. You could put a wage assignment on your pay yourself. Then your employer would mail her the check and have to deal with the refusal.

Reply: Alimony Delivery Problem

If your alimony checks are being returned, and the payee will not tell you where to forward them, open a savings account in your name and make the payments to your savings account. Just use this account to pay your alimony. Some day you will have to pay it to your spouse, and the money will be there. Be sure to document that you have asked her for a proper address and she has refused to give it to you. Your other option is to mail one more check to her and on the envelope print in caps "ADDRESS CORRECTION REQUESTED". The post office will give you a forwarding address if there is one on file.

Good luck to you!
