How long do you have to be married to be able to sue for alimony?

There is no set time that one must be married in order to ask for alimony. As a general rule, the duration of the alimony is for one-half of the length of the marriage. For example, in a two year long marriage, there might be one year of alimony payments ordered.

There are a number of different factors that are used in determining the amount of spousal support. Amongst them are the standard of living, the ability of the supported spouse to obtain employment, the length of the marriage, the income and ability of the supporting spouse to earn money and others.

Technically there is no alimony in California, only spousal support and there is no time limit on how long you need to be married, however, as the other attorney's said, time may be an important factor. Spousal support has so many variables, including what judge you appear before to set spousal support, that you should have an attorney. If your income entitles you to spousal support, then the court will also, probably, order your husband to pay a portion of your attorney's fees. If I thought that you could handle this on your own, I would tell you so, but on this case you should consult with a family law attorney dealing in support matters. Good Luck, Pat McCrary
