Legal Question in Family Law in California

Back pay child support

Investigator My husband has a child from a previous marriage, was paying the mother of his first child, in good faith, cash in child support(not thru the courts) in the amount of $300.00 every two weeks. During this time they were not divorce and we were not married. However the mother of his first child filed for divorce and my now husband provided all information willing over the phone to her. A few months later we get a letter from the DA'S office saying he owes over 5g of child support that was 11yrs ago today, now it is over 30g today. He is sending a check to the DA's office every two weeks in amt of $189.00 plus we have a child of our own and I have one from a previous relationship that we both support.

My mother would like to signed the existing house that we live in now over to my name but I am not to sure if the DA'S office will put a lean over the house because of the back pay of the child support. What can I do?

Re: Back pay child support

It sounds like you have a lot if issues that you have to deal with. You may be able to file a motion with the court to set the arrears, if any, or to get a credit. Hopefully, it is not too late if you are making payments now. Get the advice of an attorney right away.

Take all of the documents that you have to the attorney. Good Luck, Pat McCrary
