is my brothers marriage valid?

My brother was married on july 4th 2007. his wife was married to another man 12 years ago and tried to get a divorce after having his child and finding out he is an arsonist which never went through. after being seperated for almost 11 years can divorce happen automatically or is my brothers marriage illegal?

If she was married when she married your brother, then her marriage to your brother is void.

"illegal" is such a harsh term. probably, its not a vaild marriage. but please note that i use the word "probably". additionally, although not vaild, the courts may treat their community property as quasi community property, as if they were legally married. if you or your brother need assistance, please contact me at [email protected]. we represent folks in san diego, and throughout california.
