ca residency

How long does it take to establish

residency in the state of CA? I wish to

file for divorce in CA and just moved

back to CA from TX?

California law requires that at least one of the parties has lived in the state for at least 6 months and in the county where the case is filed for at least 3 months prior to filing.

6 months in the state of CA, and 3 months in the county in which the divorce is filed. You may also consider filing for legal separation if you don’t meet the residency requirements, but this is not always advisable. You should consult a family law attorney to determine the proper course.
