Legal Question in Family Law in California

Is my cash aid filling in for my support?

I was awarded full custody of my 4 children --power of attorney reguarding our home-child support for all 4 kids ages 13 12 10 and 8 and spousal support also--the problem is that I have no access to documentation of my (soon to be ex-husbands) financial affairs nor do I know exactly how much money he makes--he left the house and only returns every 5-6 weeks for a day or two--but he gives me no imformation what so ever--my only hint is that a neighbor happenend to see his check sitting on the table on rare day he was home(i went to my parents) and said it was for a two week period and was for 3,600+ dollars. The judge said that without any numbers he could not make an educated decision about the amount to be paid to me--and that I would have to go threw the district attorneys office--so what do I do? call them? Im guessing that they will go after him but what does it entitle? also I am getting cash aid and food stamps for the city--does that replace my support? or does he owe me back support from the date of the hearing?

There are several things you can do to find out how much he earns, including a subpena to his employer. Will you get support retroactive to the first hearing, it depends on what the judge ordered and whether he stated the order will be retroactive. Plan on more delays by going to the Department of Child Support Services. How much money have you lost so far and how much would it cost you to retain an attorney? I bet if you work that equation you will set an appointment with an attorney within 48 hours. Good Luck, Pat McCrary
