Legal Question in Family Law in California

child custody

My exgirl friend and I have children together . we were together for 6 years. She decided to move out with a girlfriend. At which time she took my 10month old son. My five year old son remained with me . I want joint custody of both children. She wants sole custody. For the past three months these children have not been together because in order to get one I have to give her the other. This is not fair to the children or us. She does not see it that way. I've tried to make an agreement with her she refuses. I pay her 200.00 a month plus her rent and I carry insurance for both children though my work. This girl has a very unstable mind and She has physically attack me and my property on several occassion. Only one documented with police. I want custody of my children and I want them to be together. I 'am currently on unemplyment and do not have the funds to be able to offord an attorney. But there is no custody established on either side at this time. How do I get custody even legal aid wanted 700.00. which I cant afford at this time. My unemployment is only temp and should be returning back work next month at which I make a great living. Just new in the business and have to work my way up the ladder . Please help!

you need to go to court and get a custody and visitation order. that is your only option. you will get no where otherwise.

Your solution is much easier than you currently imagine and that is a paternity action. You will be ordered to mediation on the child sharing issues and your positions sound much more reasonable than the mother's. If you really cannot afford an attorney, see if your local court has a facilitator's office to help you fill out the paperwork, but I really recommend your own attorney who can give you good rational advice. Otherwise, you cannot afford (and your children cannot afford) not to get an attorney so that stability can be brought into your children's lifes. Good Luck, Pat McCrary
