child custody

My ex and i were never married. she has had little or no contact with our kids ahes 3 and 5 for the last 2 years. we share legal custody, i have physical custody. she has reasonable visitation.she has been in and out of jail, drug use, 5 year old is in therapy with severe emotional problems from when he lived with her 3 yrs ago. she just had another baby and just started calling wanting to see and talk to the kids. can i get sole legal custody so that she cant see the kids? my 3 year old doesnt even know her, my wife is her mother. 5 year olds doctor says its not in his best interest to see her. what are my chances of winning?

Re: child custody

You should file a motion to modify custody to visits supervised by a child therapist. You will need the therapist for the five year old to state that it would be detrimental for visitation with mother to occur at this time.
