Legal Question in Family Law in California

Child Custody

I am having problems with my ex. We have a court order where I have sole physical and we have joint legal custody. I would like sole legal custody. Is is possible for me to get that? What are my chances? He only has 9 hours of visitation a week. He is very difficult and argumentative with me in every aspect. Also, I am taking her out of the country for 2 weeks to visit a dying relative. I have already obtained her passport and I have already informed him. Can he call child abduction even if I informed him?

Re: Child Custody

To travel internationally as one parent with a child, you are supposed to have either a court order permitting it, or your ex's notarized authorization. I know people get away without either, but usually not and now you have an immediate problem. If nothing else, take a certified copy of your judgment and harp on sole physical custody.

Why is joint legal custody such a big deal? It only requires that you communicate about decision making related to the health, education and welfare of the kid(s). If he is so difficult, communicate via email, text, or sign up for myfamilywizard. Getting sole legal custody when you have any type of an interested parent on the other side is not easy.
