Legal Question in Family Law in California

child custody

My son was born 2/8/03 and I married his father on 10/17/03. My sons father is from the Bahamas and became legal here through our marriage. I have not lived in the same house or been in a relationship with him in almost 4 years, but we are still married. He has had minimal contact with our son and has never offered any financial support. Our son has always lived with me but I have no court orders. I recently moved from CA to GA without notifying him. He has now served me w-divorce papers & request for joint custody in CA. I want to know if I will have to take my son back to CA since I did not get permission to move. My sons father has also threatened to take my son back to the Bahamas and not bring him back & I do not have parental rights in the Bahamas. I would never see my child again. Is this reason enough to ask for sole custody with only supervised visitation with his father? Thank you!

You should not have taken him out of California. Any how...because he was never a part of your son's life you have a good argument. If the case is in the Los Angeles area, I can help you.
