Child Custody

My son has had his son's for four years now, and now the mother wants the boys back. The boys don't want to go with her can she take them? they are 10 and 13 teen? I have to say she has full custody, but she gave my son the boys.

Just because she wants them back doesn't mean she will get them back. However, if she has a court order, she can have the police show up, show them the order for custody, and the boys will have to go with her. Your son needs to file an Order to Show Cause immediately (ex parte) asking for temporary custody while this gets worked out.

Your son needs to file a modification of custody with the court. Since he has had the children for so long he should have a good chance of getting the custody changed. That is the short easy answer, there are a lot of factors that will effect this so please contact the office so we can discuss it in more detail.
