Legal Question in Family Law in California

Child and Spousal Support

Please help! I have a Court Ordered Child and Spousal support amount which I received sometime ago. Just this past August, my ex-husband (Petitioner) arbitrarely took it upon himself to reduce said amount which is $250.00 less a month. I can't hire the attorney that represented me because I do not have the funds to cover his services. Does he have that right to change the amount of what he has pay per month. Also he is claiming that the deduction is due to the fact of a credit card under his name he paid off through a credit counseling company. When at the time of our hearing the judge ordered that we split the dept. He take his credit cards and I took mine. But he is still charging me for it. I'm backed into a wall and don't see a door to open. I know that he owes me money from back child and spousal support. Do you think I can get his wages garnished and make him pay me back all that money? Now he wants me to pay 1/2 of our children's medical insurance and is going to reduce his payment to me another $100.00. I won't be able to cover my rent if he does that. Please help me. Your assistance would be greatly appreciated.

Re: Child and Spousal Support

You need to go to the District Attorney's office Child support division and open up a case and request that they enforce the order for you. You can always retain a lawyer to do this for you as well. You need to file an OSC RE: Contempt for his violation of Court orders, you may get attorneys fees for having had to do this.
