Legal Question in Family Law in California

Child Support For 3 Children

I am an enlisted military employee in the navy. I have three children. I have an established child support order payment for two of my kids from my only marriage of $950 a month. My other child is with a my ex-girlfriend. Who lives in the state of Virgina. She only has one child and that is with me. She child filed support orders against me with the Hampton, Virgina child support services office and did not tell them that I had to other kids I payed 950 a month for. So they have ordered and taken $809 thru the military DFAS pay system out of my paycheck for my one child. I sent DFAS an affdavit stating I had two other children, so that amount can be changed with the military. I need to get an attorney in San Diego to settle my child estimates fairly and notify the state of Virginia that my ex-girlfirend is given them fasle information. My real other question is I plan on getting married in two weeks to my finance. She is a military civilian. Her annual income is between $33,000 to $35,000 a year. She also has a child and recives no child support from the father. If I marry will my child payments once settled correctly by the attorney I be higher based on her income? Please reply back. Thank you.

Re: Child Support For 3 Children

Your child support payments based upon marriage to your fiance will vary only by reason of your tax status. It may possibly go down because of your tax status changes. Do not do anything on the child support from Virginia until you talk to an attorney who is familiar with interstate child support matters. You may call my office and tell my staff I have agreed to waive the initial consultation fee. I need to review all of the documents that you have concerning your cases. You may be able to reduce the child support for your other children because of the child support paid to the third child. Act immediately as time will cost you money. Good Luck, Pat McCrary
