Legal Question in Family Law in California

Can I get child support payments back?

I have been paying child support now for almost 3 years. I just had a paternity test done because of some questions I had about whether I was the father or not. The test came out that I was not the father. Will I be able to get back the thousands of dollars that I paid in child support over the last 3 years? Thanks for your help.

Re: Can I get child support payments back?

Probably not, however, that depends on many more facts than you have stated. Get a consultation with a family law attorney and take him all of your paperwork, including legal paperwork. He can give you a more definitive answer. Good Luck, Pat McCrary

While I do not expect you will be able to recoup the monies paid, you may be forced to continue payment depending on order, etc. Call and we can look at all docs, etc and see what can be done. Don Holben 800-685-6950

It may not be as easy as you would think. You may not even be relieved from future child support payments. Does the mother have assets to go after? If she does it may be worth attempting a fraud and deciet action if she represented to you that the child was yours. Call me directly at (619) 222-3504.
