Legal Question in Family Law in California

child support

My ex son-in-law is refusing to pay the court mandated child support to my daughter because he says he doesn't have any money. He's perfectly able to work. What is her recourse here?

Thanks

Re: child support

Each county has a child support services department. They can take action to get a court order for child support. The court can set support using his ability to earn rather than his current income. The court will also issue an order for him to seek employment. If there is already a child support order she can file an OSC contempt for the unpaid child support. She should move forward with this matter quickly, particularly if there is no child support order. If there is no child support order the court cannot go back and order that he pay child support for a time prior to the time a request for support is filed with the court.
