Childs name change

My child has my maiden name as a last name and the biological fathers whereabouts are unknown. Do I still need permission to change his name to my new married name?

The response to your question depends upon whether or not there is a judgment that he is the father. Also do you want to change his name legally or just for school etc. To legally change his name would require a court order. To get the court order will require notice to your child's father and any of the child's siblings. Notice to his father can be accomplished by publication if he cannot be found after a reasonable search.
