Legal Question in Family Law in California

Collecting from CalPERS

I have a Ruling on Motion for Modification of CS. I sent CalPERS a witholding for support order last week. They phoned me yesterday and said they couldn't pay me because the ex didn't sign over the monies. He is in arrears 31,000. and counting. This is the only place to attach to collect these funds. Now what do I do? I am momentarily and monetarily devastated. This has taken over 10 months to get this far.

A QDRO is used to divide a pension plan between husband and wife. You appear to be attempting collect child support. If he is collecting retirement then you should be able to collect some portion. If he is not collecting his retirement you should be able to attache his wages. Contact an attorney with your paperwork to learn more about your options.
