Legal Question in Family Law in California

Help Me Please

I need help me and my common law husband have been together for 16 yrs i need to know this i am leaving him we have 5 kids together the house is in his name only but we bought the house while we were together he told me that the house was under both of our names i found out that its under his name only I've paid the property taxes and morgage payment also are me and my kids intitle to this house

In California no matter how you live together the law does not consider you to be married. Unmarried couples are not controlled by community property laws. However, you may be able to prove in court that there was an agreement to share the increase in your assets. Further if you lived in another state where common law marriage is provided for and met the requirements, then California would recognize the marriage. You need to consult with an attorney as this is a comples area of the law.
