Can my wife sue my ex mistress for ''Lost of consortium'' and ''alienation of affection'' and if so, how?

it is my understanding that California does not provide for either such cause of action.

While I do not believe either cause of action can be pursued under such facts as noted, I do know that in California you can sue for loss of consortium in a civil action. Call and I will be happy to research. 800-685-6950

I can tell you with certainty that California does not recognize a cause of action based in alienation of affection. I am not certain about loss of consortium. You may want to post the same question in a civil litigation are instead of family law.
