Legal Question in Family Law in California

I am having the courts review my current child support order to increase the amount that my ex-husband is paying to the state recommended amount based on their child-support calculator. I am a single parent and do not have the funds to hire an attorney. My ex-husband has hired an attorney and the documents that were sent to me by his attorney state that he is requesting that the court base the child support that he pay on his base pay with a bonus schedule (for overtime pay) and not take into consideration his overtime pay. My husband states that he no longer will be working overtime unless it is forced. He has for the past 9 years made $40k+ per year in overtime pay and his income tax records will show that. My question is how likely is it that the courts will grant him his request to base the child support on his base pay? He has submitted paystub showing that he made $70k this year in overtime alone.

To properly represent your legal position, you really need the help of a skilled family law attorney. Please file a request with the court for attorney fees and ask for the support hearing to be continued long enough so you can secure counsel.
