Legal Question in Family Law in California

Crazy divorce

My soon to be ex husband filed for divorce on July 13. He hasn't served me papers yet. I amended the divorce because I want full custody of our daughter. Now I need to serve him. What happens if he doesn't serve me within his elotted time?(his court date is set for aug. 14) Will I still be able to serve him? And if he serves me, will that wash out my court date?(aug.21)

Re: Crazy divorce

You can serve him any time you want, but make sure you do it at least 21 days before the hearing, in person. Just because he serves you with an OSC doesn't mean that you can't have an OSC. What would be good is if you guys try to get the OSCs to be heard on the same date.
