Custody Case

My cousin is incarcerated and I have temporary custody of her 5 year old daughter. I've had her for about seven months and for the first time in her life her biological father has decided that he wants sole custody of her now that her mother in incarcerated. This man has never paid child support or been around for his child. Within the past month he's served the mother who is incarcerated, with custody papers. She will not be able to attend this hearing and he knows that. I allowed him to see the child for a few hours here and there but now he refuses to give her back and the police can't do anything because he's her father. The court date is within the next month. I want at least split custody or visitation. How should I go about this or What should I do?

I'd go to court ex parte for an order giving you custody until a court hearing.
