Legal Question in Family Law in California

custody and moving restriction

I have a 2 1/2 yr old son and his father and I were never married and have never been to court over him. He promised to help me take care of him and well he does not always come thru. I havent heard from him for almost 6 months and and he has not financially helped out for almost 9 months. I'm now married and my husbands work may be moving us about 4 hours away in the same state. What legal procedures must we do in order to move with his work?

File an Order to Show Cause for a move away order.
