Custody moving out of state

My husband is in jail for spousal rape, and will be sentenced on May 15th. Though we've had a Restraining Order this entire time, the final hearing to determine custody (I have sole legal and physical now) is on May 23rd. I'm in the process (before all of this comes to fruition of moving out of state to be near family and because we are still very afraid of him. Am I violating anything legally by moving?
