Legal Question in Family Law in California

my daughter is 14 and I want to get full costody I have not seen her father in at least 10 years I do know where he is at due to reserch on my part. I found out he is in jail in Nevada. The reason I want to get sole costody now because I want to take her on a trip and I can not get a passport for her what can I do. And how much is it going to cost me

First you should propose to father that he agree to your having sole legal and physical custody. If he will not agree then you need to file a motion requesting sole legal and physical custody. He will have to be served in the Nevada Prison. This assumes that there is a current custody anf visitation order. If there is not an existing court order then you will need to file a petition to dissolve the marriage or to establish paternity. The cost will include court filing fees and the cost to have his personally served. The attorney fee will depend upon the extent you want the attorney involved in the process.
