Legal Question in Family Law in California

I have a daughter that's 3 years old. My ex-boyfriend name is on the birth certificate. But he isn't the biological father thru DNA testing. He's been helping me raise her. I want his name off the birth certificate. Is it too later after 3 years. I'm planning to file for wel fare? Does he have to pay child support? I can't get a hold of the real father? What choices do i have?

You have some very serious legal issues here. You really need a qualified attorney's assistance. If the child is 3, it would be hard to challenge the paternity now. If you apply for welfare, they would go after the "father" to pay child support. You should give them the name of the actual father and let them figure it out. But, DCSS may choose to take the simple route and go after the man listed on the birth certificate. Good luck!
