Legal Question in Family Law in California

Denied the right to mediation ...

there is a review hearing next week regarding a change in visitation by the n/c parent, this change by the n/c parent is riding solely on a recent report to the court by minors counsel. minors counsel is recommending a 50/50 from a plan we have been on for 4 years now. everyother weekend and mid week, quite baffeling to many is that there has not been anything at all different such as a job change, move, etc. to substantiate this. it dawned on me that we had not been to mediation in a year. so last week we exparte to request this. the n/c parents attorney was present as well as mine. though minors counsel was made aware of this. he did not show up. the judge denied this without prejudice because he was not present. the n/c attorney argued why did we wait all this time for it. i had asked my counsel a long time ago this is what i wanted. since the n/c parent is trying for a complete altering of the childrens continuity, and a total disruption of there established patterns. how in the world can this be pushed by minors counsel without mediation? will a judge really stall my right to mediation. our mediator knows all parties very well, and i have to admit alot more complete than the minors counsel!

You should discuss this matter with your attorney, or another attorney that practises family law in the county in which your case is being held.
