in a divorce case is the spouse that is not suplling medcal insurance required the pay the spouce supling the insurance half of the cost for dependents and the full amount for the none supling spouce in the state of california

When a petition for disolution of marriage is filed the spouses are prohibited from changing the beneficiary of an insurance policy, This includes removing a spouse from a medical insurance policy. The cost of paying the medical insurance is normally born the the policy holder. However, the court could alter that arrangement. After the divorce is final and the marriage no longer exists the non policy holder spouse is no longer eligible for coverage as a spouse. At that time the non policy holder spouse can either use COBRA coverage or seek another medical insurance coverage.
