Legal Question in Family Law in California

Divorce and health insurance

Ok.. I am wanting to file for divorce however I am needing to have a surgery done and I have medical insurance through my husband. If I filed will I still be on his insurance or would I be removed from it immediately? A friend of mine said I would be on his insurance until our divorce is final. He also said I can ask to be continued on his insurance after the divorce is final as part of Spousal Support. I am confused. Any advice would be greatly appreciated. Thank You!

Reply: Divorce and health insurance

In a general sense, when a divorce petition is filed in California, there is an automatic temporary restraining order (ATRO) preventing the parties from cancelling health insurance among other things.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
