Legal Question in Family Law in California

Going through divorce, husband not paying as he agreed to

I'm currently going through a divorce, which will be final next month! Since we've split my husband has agreed to sending me money, but never send when he says he will and so all credit card payments are late or past due. My credit has dropped significally since we split up! I had great credit for my age and now its horrible! I cant afford to make the payments on my owe. I was used to two incomes and have had to adjust to one, will all the same bills if not more!

I have a written, signed and notarized agreement by my husband as to the amount he's supossed to send me every two weeks and it will be apart of my divorce.

I really want to try and build my credit back up, and so I'm in the process of apply for a personal loan to pay off some of the credit card bills and have just one payment! My question is if I decide to take my ex to court to try and collect on what he owes me, if the credit cards are paid off will it effect collecting the money from him? I can provide more information if needed.... I look forward to anyones response! Any help on trying to collect the amount due would also be great! Thanks!

Re: Going through divorce, husband not paying as he agreed to

You should act immediately to obtain either a written agreement which is made into a court order or go to and get the court order for these payments. Otherwise you may be foreclosed from collecting these payments.
