Legal Question in Family Law in California

Divorce (missing spouse)

How do I go about filing for a divorce when I haven't a clue where my spouse is? It's been under five since we were married, there isn't any assets and there aren't any children. I live in Huntington Beach (Orange County) and I would like to know the closest place to pick up forms and which ones that I need to fill out.

In a general sense, if you have lived in Orange County continually for the past 6 months, you would file in Orange County and serve by publication.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

This is not form practice. A diligent search for your spouse must be made, then an Order for Service by Publication may be made via ex parte appearance. You will need representation. Call me directly at (619) 222-3504.
