Legal Question in Family Law in California

divorce

I have a question re: divorce - A divorce was filed in 1985, but was never finalized. It is in the archives of the Superior Court now. Is it possible to open this case again & finalize the divorce, or do we need to file a new one. One of the parties is out of the country, now lives in Mexico.

Good question. First check the Superior Court file to determine if the case was dismissed and why. If dismissed, then, no final divorce and you would have to start over again. Please contact me if you need assistance. Thanks for inquiring.

More likely than not, you can proceed with the old case, depending upon the contents of the court file.

I suggest that you obtain a copy of the court file, and consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
