Legal Question in Family Law in California

My Ex and I have been divorced for several years now. He currently asked me if he could get a passport for our son who is 8 years old. I don't feel comfortable with this because my son has chronic asthma, and there has been mulitple times he gone with his father and come back ill and I had to take him to the doctors/ or er. Also, there is no reason for my son to be out of the country. Also, while we were going through the court proceedings he had taken my son from me and didn't return him. Is there I could do base on what he is asking for? We already have a court order stating to not take my son out of california which he has already done but I found out after my son came back home to me.

You are under no obligation to agree to let him get your son a passport, especially if there is a court order against the child leaving the state. With that order, there is NO use for a passport. If he goes to court to ask for one, raise his past conduct as why it should not be granted, or if it is granted that you be given custody of the passport.
