Legal Question in Family Law in California

Hello. I have been divorced for 4 years. My ex has a history of suicide attempts (none documented or reported to authorities, however). He has openly talked about suicide in front of our two kids, ages 13 and 11 now. I do not feel safe leaving them with him. What are the chances I can get full custody based on his mental state?

Your situation sounds serious enough to return to court on a request for order . When you file your motion , include very detailed declarations covering the times he stated his suicidal tendencies and tried to act out on them. It may be necessary for Family Court services mediators to interview the children or have a therapist do that to find out what their exposure has been to dad while he's been saying these things or behaving this way. You really need the assistance of an experienced family law attorney to return to court.
