Legal Question in Family Law in California

Double Jeopardy in Family Law?

If you have criminal charges against you for a non- custodial parent missing their visit, can you also be held in contempt in family court for those same missed visits? Is there like a double jeopardy thing? Also, one lawyer told me that you can't file contempt for the non-custodial parent canceling their weekend and another lawyer told me that you could. Which is it? I get found in contempt if I cancel the weekend, so I'd like to file contempt for my ex canceling his own weekend. Kind of like reverse contempt. Can that be done or not? I am in the process of interviewing attorneys to handle this for me but need this answered first. Thank you.

Re: Double Jeopardy in Family Law?

The family law action is a civil action. The criminal action is criminal. There is no double jeopardy in botha criminal case and a contempt in family court proceeding on the same facts.
