Legal Question in Family Law in California

Who gets the engagement ring when the wedding is off?

My ex-fiance and I were engaged for approximately 6 months before ending the relationship. It was a mutual decision to end the relationship and this documented in writing (e-mail). I want the ring returned to me. Am I entitled to have it?

NO you gave her the ring. It is hers. If she wishes to keep it she may do so.

Lyle is right in that a gift cannot be revoked once it is accepted but I think you could make an argument that might stand up in court by arguing that it was not an outright gift but given in exchange for a promise to marry. after all, if she turned you down you would not have given her the ring, right? since she didnt keep her end of the bargin she should be allowed to keep the ring. It might work. you were right to break it off, if she had any class at all she would give the ring back.
