enhancement settlements

my wife and i are seperated, not legally just a mutual agreement, i am going to receive a large amout of mone from this settlement, she wants half the amount, is she entitled to a certain percentage? The several people sued a company for not paying overtime, that was the means of the case.

You probably will have to pay her one half of the settlement that you recieve, however, you should have your dissolution and the settlement reviewed by a family law attorney to make sure that you are not giving her too much. Good Luck, Pat McCrary

The answer likely depends on when you earned that overtime--if it or a part of it was earned before your separation, that amount is likely community property and she'd be entitled to a 1/2 community share of that amount, if any.
