Legal Question in Family Law in California

My exhusband has been arrested/ and or reported on more than once for domestic violance (to his current girlfriend), but never convicted. the charges have always been dropped. If i chose to modify the court order visitaion would a judge take into consideration these arrests/and reports made.

He is not a good influence to my 11 year old son but never physically harmed our son. His fathers house is not a mentally healthy enviorment.

He has court ordered visitaion every other weekend.

If the charges have been dropped for lack of evidence, you might have a tough time. If they have been dropped for some other reason and there is admissible evidence of domestic violence, you have a very good case for a significant modification of the custody order, probably including only supervised visitation.
