Legal Question in Family Law in California

can my ex-husband sue for half my house ?

I and my now ex-husband sold our house and divided the money equally . Before the divorce was final I used my share of the money and bought a house . Can he still get half of my house ?

Re: can my ex-husband sue for half my house ?

It depends. If you have some type of written proof that at the time you sold the house and divided the proceeds that your intent was to divide community property equally into separate property, then no.

Otherwise depending on the stage of the divorce when you split the money, the character of the house at the time of the split, etc. there may be some colorable claim by him. Keep in mind that if he could make some type of claim on your use of the money, so could you on his use; unless he used it to spend for things which no longer exist, like food, vacations or booze.

Good luck.
